4. Our contract with you.

This is a legally binding contract and there are several other terms and policies which you accept by using our services (so you should read them before using our website!) We may change these terms at any time but if the changes are major, we will give you notice.

4.1 These terms apply to any use of our services, and additional terms may also apply on promotional items. By using our apps, visiting our websites and/or by registering and/or using the services, you agree to be, and are, bound by:

4.3 All of the terms and conditions, rules and policies referred to in paragraph 4.1 shall be collectively referred to as the “terms and conditions”.

5. Opening an account.

(c) you are legally capable of entering into binding contracts, including these terms and conditions and any bets you place;

(d) you understand the risk that when using our services, you may lose money as well as win money;

(e) you understand and accept that when you place bets, they are only valid when accepted in accordance with the Sports Betting Rules and/or the Gaming Rules;

(f) you are opening your account solely for your personal use, and that you are acting on your own behalf and not as an agent on behalf of a third party;

(g) you have not previously had an account closed by BetVictor for any reason;

(h) you will not try to sell or in any way transfer the benefit of your account to any third party and nor will you acquire or attempt to acquire an account which has been opened in the name of a third party;

(i) you are entirely responsible for complying (and that you comply) with your own local, national, federal, state or other laws concerning betting and gaming prior to opening an account, placing any bets, stakes or wagers or using our services. If you are located in a country where use of a particular service is prohibited, you must not (i) register with us for the applicable service; (ii) attempt to use that service; or (iii) use your payment card or other payment method to undertake betting or gaming with us for the unlawful service;

(j) you are not prohibited for any reason from betting with us or from using the services; and

(k) you are not currently subject to a self-exclusion from a BetVictor account and neither we nor any other operator has excluded you, from gambling and you have not signed up to any remote gambling national self-exclusion scheme (for example, GAMSTOP).

5.2 The availability of our services does not constitute an offer, solicitation or invitation by us for the use of our services in any jurisdictions in which such use is prohibited by law. If you use our services in breach of any local, national, federal, state or other laws that apply to you in your country, we will not be liable to you for such use.

5.3 You must keep your personal details up-to-date. If you fail to do so, it may result in your bets or payment being declined or issued incorrectly. You can update your details in the account section of our apps or website. If you have any trouble doing this, you can contact our Customer Services Team to update your details for you.

5.4 You may not transfer any funds from one BetVictor account to another account for any reason.

5.5 If you breach any of the terms in this paragraph:

(a) we may cancel any bet you may have placed;

(b) we will not be obliged to pay any winnings which might otherwise have been payable in respect of any bet you placed; and

(c) we may refer the matter to the police, or any other appropriate regulatory authority.

5.6 You agree that we are entitled to carry out verification checks on you when you open an account with us. By accepting these terms and conditions and/or registering to use the apps and/or website you agree that we are entitled to conduct any and all such identification, credit, affordability, fraud and other verification checks from time to time that we may require and/or are required by applicable laws and regulations and/or by the relevant regulatory authorities for use of the apps and/or website and our products generally. You agree that you will provide us with all information that we require in connection with such verification checks. In particular, you will need to provide us with the information specified in the Age Check, the Identity Check ,the Source of Funds or Source of Wealth (“SOF/SOW”) ”) Check and the Occupation and Salary (“O&S”) Check and you agree that may use any personal information provided by you for the purposes of verifying your age, identity and source of funds. We will be entitled to suspend or restrict your account in any way that we think is appropriate (including to certain parts of our website), until we have completed those verification checks to our satisfaction.

5.7 In addition to electronic verification checks, we may carry out manual checks to confirm proof of address and proof of identity. We may ask you to submit a copy of your identity documents to our Customer Services Team to enable them to confirm your identity, and this may include them carrying out public searches on you.

5.8 We will provide your details to certain third parties for verification. As part of the registration and verification process, we will supply your information details to authorised credit reference agencies or fraud tool suppliers to confirm your identity and payment provider details. You agree that we may process such information in connection with your registration and verification.

5.9 We may need to repeat or refresh any of the above checks during the lifetime of your account. In the same way as before, you agree that you will provide us with all information that we require and we will be entitled to suspend or restrict your account in any way that we think is appropriate until we have completed those verification checks to our satisfaction.

6. Underage Customers

Simply put

You must be over 18 to use our services. It is illegal for you to use our services if you are under 18. If we discover that you are underage, we will take steps to block your account and void your bets. We may also need to report you to the authorities.

6.1 You acknowledge that use of our services if you are under 18 is illegal. If we suspect that you are not at least 18 years old, we will require Age Check documentation from you and may suspend your account until the checks are completed. If we discover that you are under 18 or were under 18 when you entered into any betting transactions via our apps or website (“Under Age”):

(a) we will immediately stop you from entering into any betting transactions or making any withdrawals from or use of your account;

(b) we will void any sports bets and/or casino wagers which you may have already made;

(c) we will investigate the claim that you are or were Under Age, including whether in fact you have been betting as an agent for or at the request of or on behalf of another person;

(d) we will return any funds deposited into your account which were placed by you while you were Under Age but you will not receive any winnings you may have made from those bets. If you have already received winnings which are in excess of deposits you have made, your deposit funds are deemed to have been re-instated and you will not receive anything further back; and

(e) we will close your account.

6.2 In addition to the above, we may:

(a) exclude you from having a BetVictor account for a specified length of time; and

(b) report you to the Great Britain Gambling Commission; and

(c) report you to any other relevant authority, who may refer the matter to the local prosecution authorities.

7. Restricted territories.

Simply put

It is your responsibility to make sure you are gambling legally, and we might have to block you if you go on holiday to a country where gambling is not allowed.

7.1 Internet gambling may not be legal in some jurisdictions. You understand and accept that the we cannot provide you with any legal advice or assurances in respect of your use of our services and so we make no representations whatsoever as to the legality of the services in your jurisdiction. You should check the relevant laws in your jurisdiction before registering with us and using our services as it is your responsibility to ensure that you are gambling legally.

7.2 Due to the above, we are not permitted to allow persons who are located in certain territories to open accounts with us (and we do not permit accounts to be accessed and operated in those territories). Please be aware that if you are permitted to open an account with us because you are registered in a territory where gambling is legal but you then travel to another territory where we are not permitted to offer gambling, you may not be able to access our services. The territories which are prohibited may be changed by us from time to time, with or without prior notice to you.

8. Holding more than one account

Simply put

You are only permitted to hold one account with us and our systems prevent you from trying to register with two different email addresses.

8.1 If you already have an existing BetVictor account, you will not be permitted to open a new account with BetVictor. In addition, if you hold an existing Parimatch account you will not be permitted to open a new BetVictor account with us.

8.2 If we believe, in our sole and absolute discretion, that you have:

(a) registered and/or used more than one account with us;

(b) attempted to circumnavigate our duplicate detection systems;

(c) access and management of another BetVictor account that isn’t your own; and/or

(d) colluded with one or more other individuals using a number of different BetVictor accounts to back the same combination of selections (regardless of whether or not such bets are made separately, on different days or across a range of different prices) in an attempt to exceed the maximum pay-out or take advantage of any winnings or bonuses not otherwise available for an individual account holder across linked accounts, we will be entitled to withhold any winnings you may make from those actions, void all bonuses, free bets and winnings accrued using the duplicate account (which will be forfeited by you) and we will return all funds deposited into the duplicate account using the same payment method used to deposit the funds in the first instance. If you have already received winnings which are in excess of deposits you have made, your deposit funds are deemed to have been re-instated and you will not receive anything further back.

9. Keeping your account secure

Make sure you keep your account details secure and let us know if your details change or you think your account is being misused.

Use two factor authentication and a strong password for the best protection.

9.1 You must keep your account username and password confidential. We will not be responsible for any losses that may arise as a result of misuse of your username or password or from any unauthorised access to your account. If you have set the auto-login facility and believe someone else may be accessing your account, then you should immediately disable the auto-login facility from all of your devices and contact our Customer Services Team. You are responsible for the security of your device(s) and for all activity taking place on your account.

9.2 If you have lost or forgotten any of your account details, please contact us as soon as possible. You must inform us immediately if you believe your account details are being misused by anyone so that we can suspend your account and prevent any further unauthorised access.

9.3 We would strongly suggest: i) enabling the two factor authentication setting in your account settings; and ii) using a secure password storage facility to store any passwords (rather than using the automatic password memory on your browser) to keep your account secure.

Payments Policy

10. Depositing into your account.

Simply put

If you want to play with us, you will need to deposit money. We aren’t a bank, so you won’t get any interest on your funds, but we do protect them in the event of insolvency.

We accept a number of different payment methods, but they must be in your name and you must not deposit funds with the intention of withdrawing them immediately.

We will carry out anti-money laundering and fraud checks and report any suspicious activity.

10.1 To play our games and place bets, you need to deposit funds. Deposits can be made in a number of different currencies depending on your registration country and currency and the options available to you will be shown on the apps or website at the time you make your deposit.

10.2 We will not pay you interest on any of your account balances. You acknowledge that your account is not a bank account and you must not use it like a bank account. Your account is not insured, guaranteed, sponsored or otherwise protected by any deposit or banking insurance system or by any other similar insurance system. 10.3 Your funds are protected at the level: high protection. We are required by our licence to tell you about what happens to funds which we hold on account for you, and the extent to which funds are protected in the event of insolvency. We hold customer funds separate from company funds in an independent trust account, which is a formal trust deed established by BetVictor for the exclusive purpose of holdings customer funds and to provide a legal and practical separation of customer funds from the affairs of BetVictor. 10.4 We accept a number of different payment methods. This will vary depending on your registration country and currency and the options available to you will be shown on the apps or website at the time you make your deposit. 10.5 You are only permitted to use payment methods of which you are the account holder. You are not permitted to use any payment method belonging to a third party (e.g. you cannot use a family member’s debit card to make deposits to your accounts). Your deposits must be made from a personal account and not from any company or corporate account. If you make deposits from payment methods you are not entitled to use (eg. if you are not the account holder), we may treat that deposit as invalid (and any winnings arising from that deposit will be voided). This means that you would not be entitled to any winnings on a bet placed with those deposits.

10.6 You should only deposit funds which you intend to use to place bets. If we reasonably believe that you have deposited funds and have no intention of using that money to place bets, we may suspend or close your account and may be required to report this to the relevant authorities.

10.7 We may void your winnings if you have made deposits with the intention of placing bets using a deposit which you then reversed. If any deposit does not reach us or is cancelled by you or a third party, we will be entitled to void all bonuses, free sports bets and winnings accrued or awarded to your account as a result of that deposit if we believe, in our reasonable discretion, that the deposit was made with the sole intention to place bets using the deposit which you then cancelled.

10.8 We will carry out anti-money laundering and fraud checks on your deposits. We are required by anti-money laundering regulations and as part of our internal policies to make checks on the source of any funds placed on deposit by customers. If these checks do not provide us with sufficient information about you, we may request further information from you (including about your source of funds). You agree to promptly provide this information, when requested to do so. We reserve the right, acting reasonably, to:

a) withhold and/or retain any and all amounts which would otherwise have been paid or payable to you (including without limitation any winnings or bonus amounts); or

b) suspend or terminate any account Where we cannot satisfy ourselves that the source of funds is legitimate or where sufficient information has not been provided and we may be required to report this to the relevant authorities.

10.9 You must notify us of any changes to your payment method details. If you do not update us, your deposits or bets may be declined by your bank. You must also inform us if your debit card is lost or stolen or if you have been a victim of any identify fraud on your payment method account and we will stop further bets being accepted from your account until you notify us of further instructions.

10.10 Minimum and maximum account deposits will apply. We would like to draw your attention to the fact that minimum and maximum deposits will apply, and these will be highlighted to you via the apps or website where applicable.

10.12 You cannot make chargebacks to your account. You are not permitted to make any chargebacks, reversals or otherwise cancel any deposits into your account and if we incur any loss as a result of this activity, you will be required to reimburse us in full on demand.

11. Placing your bets.

11.2 You should get familiar with how bets and games are operated. We will not be responsible under any circumstances if you place a bet or play a game and have not fully understood the terms or how it is operated. We would recommend that you familiarise yourself with standard betting and gaming terminology. 11.3 You confirm that you are fully aware that there is a risk of losing money when gambling. By using our services, you acknowledge that you are fully responsible for any losses you may make. (b) all prices shown on our website are subject to fluctuation and are available up to the official advertised start time of the relevant event. Any sports bet placed that is accepted after the advertised start time of the applicable event, other than sports bets on in-running/in-play markets (where bets are taken after the event has commenced), will be void. However, we may, at our discretion, elect to accept a sports bet after the relevant event has begun. 11.7 We may withhold payment of winnings and declare a sports bet on an event as void if:

(a) the integrity of the event has been called into question;

(b) the price(s) has been manipulated;

(c) match rigging has taken place;

(d) there is evidence of a series of sports bets each containing the same selection(s) having been placed by or for the same customer (acting alone or in collusion with other customers); or

(e) if you have breached any betting integrity rules applicable to that bet. Evidence of the above may be based on the size, volume or pattern of sports bets placed by customers with us across any or all of our betting channels and our assessment of such evidence will be reasonable, informed and conclusive in this regard. A decision given first by the relevant governing body of the sport in question (if any) and second, by any gambling regulator, will be conclusive. If you owe us any money for any reason, we have the right to take that into account before making any payments to you.

11.8 Once winnings are available in your account, you will be able to withdraw them in accordance with the below rules. All cleared winnings will be credited to your account. These will be available to be withdrawn, subject to the above terms and conditions relating to withdrawal.

11.9 All bets and wagers are subject to maximum payouts. This is detailed in Maximum Payout Policy. It is your responsibility to ensure that you are comfortable that a bet you place, if successful, may exceed the maximum payout limit and you will therefore not be paid anything over these limits.

12. Withdrawing funds from your account.

Simply put

If you are lucky enough to have made winnings, you will need to have completed know-your-customer checks before you can take that money home.

12.1 You may withdraw funds from your account if:

(a) all payments made into your account have been confirmed as cleared and have not been charged-back, reversed or otherwise cancelled;

(b) your account is in good standing and any identity or other know-your-customer documents we had already requested have been completed to our satisfaction. We are required to conduct these know-your-customer checks pursuant to applicable anti-money laundering regulations and rules. Please also note that, where we have requested additional information from you to verify your identity and/or source of funds, any delay in providing this information may cause an additional delay when withdrawing funds;

(c) you accept that all transactions may be checked to prevent money laundering and that any transactions made by you which we deem suspicious, may be reported to the appropriate authorities. We reserve the right to decline and/or reverse the withdrawal of unspent or otherwise unused deposits until the verification of these funds is deemed satisfactory, including where deposits have been made and withdrawn immediately with no game play;

(d) you have complied with any other relevant withdrawal conditions affecting your account (e.g. any applicable bonus terms or wagering requirements); and

(e) there is currently no ongoing investigation into:

(i) a game defect involving a game which you have played which requires a temporary freeze on withdrawal of funds.

(ii)a situation where there is evidence of betting irregularities (including any attempt to exceed the maximum pay-out or take advantage of any winnings or bonuses not otherwise available), that the integrity of an underlying event has been compromised, the price may have been manipulated, match fixing may have taken place, or an individual or individuals are suspected of acting either in conspiracy or concert in respect of a bet;

(iii)a situation where there is evidence that the rules of a sport’s governing body may have been breached; or

(iv)a situation where there is evidence that you have materially breached these terms and conditions, including any Fraudulent Activity, unlawfully or by engaging in improper activity (including cheating, collusion or criminal activity).

12.2 Our security team may need to cancel withdrawals pending an investigation. In certain limited situations, our security team may need to cancel withdrawals in order to carry out additional checks. These funds will be returned to your account pending the investigation, but if we discover any irregularities during our investigation, we reserve the right to withhold funds. We may withhold funds at any time pending the determination of any internal or external investigation, including any internal or external investigation into a breach or potential breach of these terms or as required by law or to comply with any advice, request or instruction from any governmental, regulatory or enforcement authority. Responsibility for any funds lies with the account holder and any bets made with them will stand.

12.3 There is a minimum withdrawal amount and you can only withdraw less than this if your account balance is below the minimum withdrawal amount. If the balance of your account is lower than the minimum withdrawal amount, which will be shown to you at the time you withdraw, you will still be able to withdraw your funds but you will need to contact our Customer Services Team to assist.

12.4 You are responsible for declaring winnings to tax authorities. If required, it is your responsibility to declare any funds withdrawn, including winnings, to your local tax or other authorities.

12.5 You are responsible for reporting any mistakes with your withdrawals. Whilst every effort is made to avoid mistakes, we cannot take any responsibility or liability for errors or omissions you make when you are withdrawing your funds. If any funds are deposited or credited incorrectly, it is your responsibility to inform us and we will aim to resolve it.

12.6 Withdrawals must be made to the same payment method as the main funding deposit method. If this is not possible for reasons outside of your control, you will be contacted to see if there are alternative arrangements. We will attempt to accommodate your requests regarding the payment method and currency of withdrawals. If we need to process and pay withdrawals through a different payment method, there may be a charge involved and these are set out in the Withdrawing Funds Policy (which can be accessed here).

13. How we hold and deal with your payment information.

Simply put

We store details in accordance with the Payment Card Industry Data Security Standards (PCI-DSS) and delete your data if you don’t use it for 2 years.

13.1 Any transfers, deposits and withdrawals on your banking statement will show up as “BV Ltd” and for BACS/telegraphic transfers, as “BetVictor Ltd”.

13.2 We will tokenise stored card holder numbers in accordance with Payment Card Industry Data Security Standards (PCI-DSS) and only show a truncated card number (the last four digits of the card number) on the cashier page. We will notify you of any changes to the method by which we store card holder data.

13.3 We only store debit card details that you enter on the cashier page to allow you to make subsequent transactions with the same card details. We will delete the debit card details linked to your account where they are not used for a period of 24 months or more.

14. Free bet restrictions.

Simply put

Any free bets or promotions will have specific terms and conditions attached to them so ensure you read and understand these terms before using them.

All promotions have an expiry time and unused promotions will be deemed forfeited after they have expired.

14.1 If you have received a free bet, the following restrictions will apply.

14.2 Your free bet will only be valid on sports. Unless otherwise stated in any applicable promotional terms, when you receive your free bet, you will be able to use it to place a bet on any sporting event but you will not be able to use it on any other sections of the website, for example on casino games.

14.3 Your free bets will be added to your account once the system has been updated. If your free bet is due to be received after bet settlement, then your free bet will usually be credited within one hour of bet settlement, unless otherwise specified in any applicable promotional terms. If you have not received your free bets within the time specified in any applicable promotional terms or as otherwise notified to you, you can contact our Customer Services Team.

14.4 Some bet types cannot be used. Unless otherwise stated in any promotional terms or specified to you, your free bet can be used on all bet types. You should check the Betting Rules to understand how different bet types work.

14.5 When you place any bet after receiving your free bet, you will be given the option to use your free bet. If you do not select to use your free bet, it will be retained on your account until it expires, and any bets will be made using funds from your account.

14.6 Your free bet cannot be redeemed for cash at any time and must be used to place other sports bets. Once you have placed your free bet, any winnings you have made from your free bet will automatically be transferred to your account balance. You will not be entitled to any return of your free bet stake. For example, if have a free bet worth £10 and your bet at odds of 5.0 is successful, you will be entitled to a return of £40 (£50 less the £10 stake).

14.7 If your free bet is voided, provided it has not expired, it will be returned to your bonus funds balance and can be re-used within the expiry period.

14.8 Your free bet has an expiry date. If you do not use your free bet within 3 days (or such other date as specified in any applicable promotion or notified to you when you receive it) of receiving it, your free bet will automatically expire and be deleted from your account and you will no longer be able to use your free bet.

14.9 You cannot use your free bet as a qualifying bet for any promotions.

15. Other rules.

Simply put

Certain types of bet, for example Bet Boosts, Enhanced Accas and Bet Builder, may have particular rules and limits which apply to those specific bets.

15.1 Enhanced odds or bet boosts may have a maximum bet limit. If your bet exceeds the maximum permitted bet, this will be made clear to you when you place your bet. If you want to place a bet greater than the maximum bet permitted for those upgraded odds, then you will need to place these at regular odds.

15.2 Your enhanced odds or bet boosts may sometimes be restricted to a single selection bet (i.e. it cannot be used on an acca). If this applies, it will be stated on the key terms in the banner or in the betslip.

15.3 Any enhanced odds will have limited availability so once the promotion is removed from the website, you will no longer be able to take advantage of this promotion.

15.4 You will not be able to use bets placed on enhanced odds to qualify for free bets or other promotions unless stated specifically in any promotional terms and conditions.

16. Use of our apps and/or website.

Simply put

It’s your responsibility to ensure you have a secure internet connection, so if it fails and your game is disconnected, we are not accountable but we will always treat you fairly.

We might need to cancel bets taken in error and we will always notify you as soon as possible if there is an error in bet settlement. If you notice any bet settlement error, you should please tell us. If you receive monies by mistake, we can claim them back from you.

16.1 Using our betting apps and/or website may incur data charges. You accept that using our apps or visiting our website, for example outside of a paid or free WiFi network, may result in additional data charges from your mobile network provider. We will not be responsible for any data charges incurred as a result of your using the apps and/or website.

16.2 If you are disconnected, the game will resume when reconnected. If you suffer a disconnection or exit the application for any reason during a game where a further player action is required, then this game will be resumed from this same point when you log back in to the application and launch the relevant game. If you have a winning hand(s)/game and are disconnected prior to being able to ‘gamble’ on a video or slot game, your winnings will be credited to your account and you will not have the option to gamble when you reconnect. If no further decisions or action are required in an individual game following disconnection/exit, for example after the wheel spin has commenced in a roulette game, then the game will be settled and the result displayed in your account history.

16.3 You may need to download software to use our services. In order to use some of our services, you may need to download or otherwise use certain software, including software provided by third parties. You may therefore be required to enter into an end user licence agreement in respect of such software and you agree to be bound by the terms of it. You also agree not to interfere with, modify, decompile, copy, or reverse-engineer any software provided to you as part of our services except if expressly permitted or as permitted by law.

16.4 We will take all reasonable steps to resolve any problems in the software or hardware used by us to provide our services. If you are interrupted from a game and are not able to restart from exactly the same point, we will take all reasonable steps to treat you fairly (for example, by reinstating the balance on your account to the same funds as existing after the last game or bet logged on our servers prior to the problem taking place).

16.5 We may need to cancel certain bets taken in error. We will take all reasonable steps to overcome any such event but we reserve the right to cancel any sports bet and/or casino wager arising as a result of any such event or occurrence. However, there might still be situations where a sports bet and/or casino wager is accepted, or a payment is made, by us in error which includes the following:

(a) in relation to sports bets placed prior to an event taking place, the prices/terms offered are materially different from those available in the general market;

(b) in relation to an event, the price/terms offered at the time the sports bet is placed are materially incorrect in view of the publicly available information in respect of the probability of the event occurring;

(c) where we have continued to accept sports bets on a market which should have been suspended, including where the relevant event is in progress (except where ‘in-running’ bets are accepted) or had already finished (sometimes referred to as ‘late bets’);

(d) where we should not have accepted, or have the right to cancel or re-settle, a bet pursuant to the Sports Betting Rules;

(e) where an error is made by us as to the amount of winnings/returns that are paid to you, including as a result of a manual or computer input error; or

(f) where an error has been made by us as to the number of free sports bets and/or bonus casino wagers that are credited to your account;

16.6 If you become aware of any of the above errors, you should inform us as soon as you are able to. We will also use reasonable endeavours to detect any errors and inform you of them as soon as reasonably practicable. We may then:

(a) declare the bet void and return your sports bets to your account; and/or

(b) correct any error made on a bet placed and re-settle the same at the correct price or terms which were available or should have been available through BetVictor at the time that that sports bet was placed. This means that your sports bet will be deemed to have taken place on the terms which were available for that sports bet immediately before the error occurred.

16.7 If you have received monies in error, you may be required to return those monies to us. There may be circumstances where monies are paid to you in error (for example, an error on bet settlement). We will use our reasonable endeavours to detect any errors and inform you of them as soon as possible. However, if you have been credited with any monies which are due to an error then you will hold those monies on trust for us and you will have to immediately repay us if we issue you with a demand. If those monies are still in your account, then we may reclaim these monies directly from your account. In addition, if you then use funds which have been credited to your account as a result of an error to place subsequent sports bets or casino wagers, we reserve the right to cancel such sports bets, casino wager and/or withhold any winnings which you may have won.

16.8 We will not be liable if you are not able to place a bet for any reason (other than due to our negligence). We will not be liable for failures due to technical, hardware or software malfunction of any kind or lost or unavailable network conditions which prevent you from entering into any bet or promotion. We will not be liable for any losses, damages or injury which you incur due to failure to enter any promotion, including failure to win, acceptance or use of any prize. We may also need to contact you to discuss Safer Gambling or Know Your Customer information whilst you’re using our site, and we will not be liable if such an interaction interrupts your game play or prohibits you from placing a bet. Nothing in our terms and conditions will exclude our liability for fraud or death or personal injury resulting from our own negligence.

17. Unacceptable use of our services.

Simply put

We don’t tolerate any illegal behaviour so keep it honest. If we suspect you are undertaking prohibited activities, we will report you to the authorities and close your account.

17.1 You may not use illegal funds for our services or carry out unlawful activities on it. By using our services, you confirm that the sources of funds used by you for gambling are not illegal and that you will not use our services in any way as a money transfer system. You must not use our services for any unlawful or Fraudulent Activity or Prohibited Practices (both as defined below) (including money laundering) under the laws of any jurisdiction that applies to you (in particular, the laws of Gibraltar). You should report to us immediately if you believe that any other person is undertaking any Prohibited Practices. If we request it, you must cooperate fully with us in relation to any investigation into any Prohibited Practices.

17.2 If we suspect you are engaging in unlawful activities, we may suspend your access or close your account. If we reasonably suspect that you are engaging in or have engaged in Fraudulent Activity, Prohibited Practices or any other unlawful or improper activity (including but not limited to money laundering), or conduct otherwise in material violation of the terms and conditions, we may terminate your access immediately and/or block your account. In such an event:

(a) we are not obliged to return any funds that may be in your account and we reserve right to withhold and/or retain any and all amounts which would otherwise have been paid or payable to you (including without limitation any winning or bonus amounts). If we close or suspend your account, the balance of your funds will be non-refundable (including any winnings or bonus funds) and they will be deemed to be forfeited by you to the extent of any claim that we may have against you as at the date of such closure. In addition to terminating your access to the services and/or blocking or closing your account, we reserve the right to prevent you from accessing our apps, website or servers, or accessing any other services we offer; and

(b) we may report you to the authorities. We may seek criminal or contractual sanctions against you and are entitled to inform relevant authorities, other online service providers and banks, debit card companies, electronic payment providers or other financial institutions of your identity and of any suspected Fraudulent Activity, Prohibited Practices or any other unlawful or improper activity and you will cooperate fully with us in order to investigate any such activity. If the game play on your account indicates that you are using such betting techniques, we will immediately block the account and retain any funds in said account.

17.3 We may end your contract at any time, including if we suspect that you break these terms. We may restrict your access to BetVictor, temporarily suspend or permanently terminate your account, withdraw your offers for bets, void any bets outstanding to your account, cancel and void any outstanding bets in our absolute discretion without cause at any time for any reason, including but not limited to if:

(a) we suspect that you are engaging in Fraudulent Activity, Prohibited Practices or any other unlawful or improper activity;

(b) you fail any SOF Check, O&S Check or Identity Check;

(c) we are required to do so by any applicable law, rule or regulations including where we have safer gambling concerns/obligations in accordance with our licence conditions or any other regulatory requirements. If your account is closed due to safer gambling concerns, we will not enter into any further correspondence you will receive your winnings but we will not correspond with you at all);

(d) there is a material technological failure which prevents us from offering the services;

(e) you do not, within a reasonable time of us asking for it, provide us with information that is necessary for us to provide the services, for example, an updated home address if you have moved;

(f) we suspect you are acting in a manner that may result in legal liability for you, us or third parties or may be detrimental to the conduct of our business;

(g) you are taking unfair advantage of us or any other player or otherwise acting unfairly (e.g. by colluding with other players, attempting to exceed the maximum pay-out or take advantage of any winnings or bonuses not otherwise available, attempting price manipulation, taking advantage of any picture or odds latency in match screening, match fixing or acting either in conspiracy or concert with another individual in respect of a bet);

(h) we suspect that your account’s ‘public market data’ usage (‘public market data’ includes market prices, traded volumes and market depth) could represent ‘business usage’ (‘business usage’ includes any use by a betting operator or any use by an individual or organisation supplying data or services to a betting operator);

(i) we suspect that you may be having difficulties obtaining credit (suggesting issues with affordability);

(j) you become bankrupt or suffer analogous proceedings anywhere in the world;

(k) you are prohibited from entering into a bet by any term of your contract of employment or any rule of a sport governing body or other professional body which applies to you;

(l) you place a bet on any sporting match or event in which you take part (or in which a team of which you are a member, or in respect of which you are employed, takes part); or

(m) we suspect that you have (or may have) otherwise materially breached these terms and conditions.

17.4 If you have placed all of the necessary qualifying bets for a free bet promotion but not yet used the applicable free bet, you may be allowed to place the free bet in accordance with the terms on which it was granted. If you have placed some but not all of the necessary qualifying bets for a free bet promotion, you will not be allowed to place the remaining qualifying bets to complete the promotion.

18. Safer gambling.

19.2 We may make changes to any of our services. At our discretion, we may alter or amend or withdraw any betting or gaming from the services or any part thereof (including any promotions), at any time, and may alter prices, features, specifications, capabilities, functions and/or other characteristics of the bets, games and/or services. On occasion we may need to restrict access to certain parts of our website, for example during periods of maintenance and/or alteration or amendment of any of our products or services.

19.3 We may restrict your use of sports or remove you from marketing distribution lists at our sole discretion. We may, at any time at our sole discretion, remove you from marketing distribution lists so that you do not receive any future offers or promotions from us and are no longer eligible to qualify for any promotions on via our website or apps. 20. How to close or suspend your account with us.

Simply put

We will be sorry to see you go, but if you want to suspend or close your account then you can use the Safer Gambling tools or contact us to close your account.

20.1 Tell us you want to close your account. If you no longer want to keep your BetVictor account open, you have the following options:

a) go to the Safer Gambling tools where you will find options for self-exclusion or time out if you want to temporarily suspend access to your account; or

b) contact our Customer Services Team if you would like to fully close your account.

20.2 Your account will be closed within 24 hours and you will be repaid any positive balance. We will process your account closure request within 24 hours and during that time you will remain entirely responsible for all activity on your account. At the point at which we close the account we will repay any outstanding balance to you using the same method of payment which you used to deposit the funds. You may be able to later re-open your account using your same account details but you will need to check with us at that time and it will be subject to you accepting our terms and conditions which are in force as at the date your account is re-opened.

20.3 Your account may be marked as inactive if you don’t use it for 91 days. If you do not do log in, deposit, withdraw or place any sports bet or casino wager on your account for a period of 91 consecutive days, your account will be considered inactive. We will notify you if this happens and provide you with details on how you can reactive your account. Whilst your account is inactive, we may restrict any activity on your account until it is re-activated.

20.4 Your account may become dormant if you don’t use it for 396 days. If you do not deposit, withdraw or place any sports bet or casino wager on your account for a period of 396 consecutive days, your account will be considered dormant. This means that even if you log in during that period but do not deposit, withdraw or place any sports bet or casino wager, it would still be considered dormant. If your account has a balance, we will inform you in writing that your account has become dormant. If your account has become dormant and you wish to reactivate it, you will need to contact us by email at [email protected]

20.5 If your account is dormant for 5 years, we will donate your funds to charity. If your account remains as a dormant account for a period of 5 years from the time of the last transaction (ice. deposit, withdrawal, sports bet or casino wager), your account will be anonymised and any balance on your account will be donated to the GambleAware charity or any other registered charity of our choice which is dedicated to research, education and treatment of problem gambling related issues. Before we donate any of your funds to charity, we will contact you at least 30 days beforehand to:

a) remind you in a clear and transparent manner of the size of your balance;

b) to advise you that you still have a right to access the funds by contacting us within the 30-day period; and

c) to warn you that your account will be anonymised in accordance with our Privacy Notice if you do not reply to us or access your account, and that your funds will be donated to a charity.

20.6 We can deal with a customer’s executor where this is necessary. Where a customer is deceased, subject to the executor of the customer’s estate providing a copy of the customer’s death certificate and Identity Check information on the executor, we will be happy to discuss the status of and requirements for the account with the customer’s executor and will work with the executor on a case by case basis.

21. What to do if there is a problem with the services.

Simply put

We hope you will enjoy your experience with us but if you have any complaints about our services, you can raise this with our Customer Services Team who will escalate if necessary. You will need to follow the steps set out here for any complaints.

21.1 If you have a complaint, you should contact our Customer Services Team. If you have a complaint relating to sports bets and/or casino wagers on our website, your first step should be to contact our Customer Services Team as soon as reasonably practicable and give them details of your complaint. This will be escalated as necessary within our Customer Services Team until it has been resolved. We have set out below the escalation process so you can understand how this works.

21.2 STEP 1: INTERNAL INVESTIGATION. You should contact our Customer Services Team setting out details of the complaint. You should do this as soon as possible after your issue arises and in any event within 12 months. You can do this using any one of the following methods:

You will receive an automated response with receipt of the complaint or dispute. We will then review the complaint or dispute internally and respond to you fully within 14 days.

21.3 STEP 2: DEPARTMENT MANAGEMENT TEAM REVIEW. If you are unhappy with the response we have provided you in step 1, you can request that the Department Manager reviews the original outcome of the complaint/dispute. If you want to escalate to this step 2, you should contact us via email at [email protected] and mark the email “Step 2 Complaint Management Review”. Our Department Management Team will then respond to you within 14 days of your email.

21.4 STEP 3: DIRECTOR OF CUSTOMER SERVICES REVIEW. If you are still dissatisfied with the response provided under steps 1 and 2, you can request that the Director of Customer Services reviews the original outcome of the complaint / dispute. To escalate to this step 3, you should email [email protected] and mark the email “Step 3 Complaint Management Review”. Our Director of Customer Services will respond to you within `14 days of your email and in the unlikely event that the Director of Customer Services is unavailable, the complaint will be reviewed by a nominated member of Senior Management.

21.5 Please note that complaints to step 3 will only be reviewed after you have correctly followed steps 1 and 2 of the process. If you use the step 3 email address without having followed steps 1 and 2, your complaint will be referred back to the initial investigation stage (step 1).

21.6 The whole process from step 1 to 3 should take no longer than 8 weeks from when we first receive your complaint. If at any time you don’t respond to a reasonable request for information within 7 days, we might “stop the clock” until you do respond, at which point it will be restarted.

If we haven’t been able to reach any agreement with you within those 8 weeks, or if we believe we have come to a deadlock or final position, then our Director of Customer Services will issue you with a final letter which will set out:

(a) our final decision;

(b) confirmation that steps 1, 2 and 3 have been exhausted; and

(c) details of how you can escalate a complaint further externally (which is also set out in step 4 below). You should only escalate externally to step 4 after either (i) you have received the final letter referred to above or (ii) if we haven’t completed steps 1 to 3 within the 8-week timeframe.

21.7 STEP 4: INDEPENDENT BETTING ADJUDICATION SERVICE. We always aim to resolve complaints or disputes internally, but there might be instances where we cannot come to an agreeable solution. If you are still unhappy with the result after having gone through steps 1 to 3 above, you can refer the complaint or dispute to the Independent Betting Adjudication Service (“IBAS”) for independent alternative dispute resolution. If you are planning to do this, you should inform us as will then issue you with a referral number to present to IBAS (you will need this number to speak to them so make sure you get it from us).

21.8 There are a couple of tools for raising complaints available to you and which can be used as part of the complaints procedure.

(a) Resolver: You can send your complaint or dispute to Resolver at www.Resolver.co.uk. This website could be utilised as part of a step 2 complaint. Resolver is a third-party online company specialising in resolution of issues, in association with www.moneysavingexpert.com. If you access Resolver and type “BetVictor” into the company search box, the BetVictor details will appear with a “Get Started” tab and self-explanatory steps as to how you can start the complaint through Resolver (https://support.resolver.co.uk/hc/en-us/requests/new). The service is free to use.

(b) European Online Dispute Resolution Services (ODR): You can submit the matter to the ODR at: https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.chooseLanguage. The ODR platform is provided by the European Commission to make online shopping safer and fairer through access to quality dispute resolution tools. You can use it in a similar way to Resolver as a third-party online platform or you can use it to access a director of dispute resolution bodies across Europe. The ODR is not connected to BetVictor and is available in all EU languages.

22. What to do if you have a regulatory complaint.

Simply put

All our services are provided in accordance with the strictest licensing conditions and we review them on a regular basis. We take any regulatory complaints extremely seriously and these can be escalated to the regulator if necessary.

22.1 If your complaint does not relate to sports bets and/or casino wagers placed on our website but instead relates to our compliance with our licensing conditions within the last 12 months then you should follow the below process. Steps 1 to 3 mirror the process for complaints about our services so we would refer you to the relevant paragraphs above which contain contact details and full details of each step. Once you have reached Step 4, you will then be able to contact the Great Britain Gambling Commission directly.

22.2 STEP 1: INTERNAL INVESTIGATION. You should follow the same process as set out in paragraph 21.2 above.

22.3 STEP 2: DEPARTMENT MANAGEMENT TEAM REVIEW. You should follow the same process as set out in paragraph 21.3 above.

22.4 STEP 3: DIRECTOR OF CUSTOMER SERVICES REVIEW. You should follow the same process as set out in paragraph 21.4 above.

22.5 STEP 4: CONTACT THE GREAT BRITAIN GAMBLING COMMISSION. You should now finally contact the Great Britain Gambling Commission, stating that you have a “regulatory complaint against BetVictor”. You will be asked to provide details of your complaint. 23. Our responsibility for loss or damage suffered by you.

Simply put

We will provide our services with reasonable care and skill but our liability to you is limited.

23.1 We are only responsible to you for foreseeable loss and damage caused by us due to a breach of these terms. If we fail to comply with these terms and conditions we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable or any loss that didn’t result from a breach by us of these terms. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.

23.2 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation.

23.3 In certain situations, we may pay you compensation if our content is defective. If defective digital content which we have supplied damages a device or digital content belonging to you and this is caused by our failure to use reasonable care and skill, we will either repair the damage or pay you compensation. However, we will not be liable for damage which you could have avoided by following our advice to apply an update offered to you free of charge or for damage which was caused by you failing to correctly follow installation instructions or to have in place the minimum system requirements advised by us. We are not liable for losses caused by any equipment and devices you use to access our website.

23.4 We are not liable for business losses. We only supply the services for your personal use. We will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

23.5 There is a limit on our liability to you. Our maximum liability arising out of your use of the products or services (or any part of them), whether such liability arises under breach of contract, tort (including negligence) or otherwise will be limited to:

(a) where our liability relates to a sports bet or casino wager, the amount of that sports bet or casino wager and any winnings resulting from that sports bet or casino wager;

(b) where our liability relates to the misapplication of funds, the amount of money in the customer account that has been misplaced by BetVictor; and

(c) in respect of any other liability of BetVictor, the sum of ten thousand pounds Sterling (GB £10,000).

24. Indemnity.

Simply put We are relying on the statements and information you give us to provide you with our services. If you have breached these terms or any laws, we have the right to claim compensation from you for the losses you have caused us.

24.1 You agree to indemnify and hold us and our associated companies, affiliates, officers, directors, agents and employees harmless from any liabilities, claims, losses or demands made by any third party arising out of your material breach of these terms and conditions (including documents incorporated by reference) or out of your violation of any law or the rights of any third party.

24.2 You acknowledge that BetVictor and its affiliates will hold information with respect to your identity, including but not limited to your name, address and payment details. You agree that we rely on this information in entering into these terms and conditions and you agree to hold us harmless against any falsehood or inaccuracy contained in the information you provide us.

25. Intellectual property rights.

Simply put

Using our services does not give you any right to use our intellectual property rights. You are only permitted to use the services for your personal use, and you must not share our services with anyone else.

25.1 We do not grant you any rights to our intellectual property. We are the owner or authorised user or licensee of all the intellectual property rights in our services and content including, without limitation, any copyright, patent, designs (registered or unregistered), trademarks, service marks, source codes, specifications, templates, graphics, logos or any right subsisting in the UK, Gibraltar, EU or elsewhere in respect of content, databases, formats, interfaces, programming, the offering of services to other customers, software or any application for any of the foregoing and any modification, improvements, developments and enhancements thereof. 25.2 You may not distribute our content to any third parties. 27.1 We may transfer this agreement to someone else. We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.

27.2 You need our consent to transfer your rights to someone else. You may only transfer your rights or your obligations under these terms to another person if we agree to this in writing. We may use our absolute discretion in deciding whether or not to agree to any transfer.

27.3 Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms (under the Contracts (Rights of Third Parties) Act 1999).

27.4 These terms do not create any partnership. Nothing in these terms shall be construed as creating any agency, partnership, or any other form of joint venture between you and us.

27.5 If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

27.6 Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.

27.7 We are not responsible for matters beyond our reasonable control. Without affecting our obligations under the laws and regulations of the jurisdictions where we are licensed, we will not be liable for any losses or damage which may result from any; act of God; epidemic or pandemic; trade or labour dispute; power failure; act, omission or failure of any governmental or authority; failure of any telecommunication network; or any other delay or failure caused by a third party or which is outside of our control. If such an event occurs, we reserve our right to suspend or cancel our services without any liability to you.

27.8 This agreement forms the entire agreement between us. You acknowledge that you have not relied on any representation, undertaking or promise given by us or implied from anything said or written unless expressly stated in these terms and conditions.

27.9 Notices. Any notices to us must be sent to our business offices. Any notices we send to you will be sent to the email address you have supplied us with (or in some limited circumstances, your postal address), until we receive notice of any different email address or address.

27.10 Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by English law and you can bring legal proceedings in respect of the products or services in the Gibraltar courts. If you live in Scotland you can bring legal proceedings in respect of the products or services in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.

28. Definitions

Prohibited Practices: This means any of the following:

Source of Funds or Source of Wealth (“SOF/ SOW”) Check: This is a source of funds check undertaken by us (in relation to the specified benchmarks) where you may be required to disclose certain documents to us, including any of the following:

Employment: Wage slip; director remuneration documentation; dividend documentation; pension statement and/or bank statement showing regular salary payments into the account;
